教唆犯的未完成形态即教唆犯的预备、未遂和中止。在比较德国、日本、俄罗斯等大陆法系国家刑事立法和刑法理论的基础上,结合我国《刑法》规定及刑法学界的通行观点,独立教唆犯有成立预备犯的可能。教唆犯的二重性决定了教唆犯的未遂有时表现为未实行终了的未遂,但更多的表现为实行终了的未遂。教唆犯成立犯罪中止并不一定要以自动有效地制止被教唆者的犯罪行为或有效防止被教唆者犯罪行为可能发生的犯罪结果为必要条件.教唆犯甚至无需采取任何措施也可成立中止犯。  相似文献

African American youth are generally as likely as their peers from other racial and ethnic groups to aspire to earn a college degree; yet, in spite of their aspirations these students remain under-represented in college enrollment and graduation. Part of the disparity between these students’ aspirations and the realization of their goals may lie in their minimal college knowledge and nominal participation in postsecondary preparatory activities that have frequently been caused by the historic, and ongoing, systematic disenfranchisement of African Americans. During interviews, college students reflected on how similarly-aged family members, peers, co-workers, and parishioners assisted with various aspects of college preparation and enrollment. The community cultural wealth framework helps us understand the reason for, and importance of, this ‘lateral mentorship’ in the fulfillment of these students’ college aspirations. Consequently, educators and educational systems are challenged to be more responsive to the college preparatory needs of traditionally under-represented college-going populations.  相似文献

Rape survivors, as witnesses, are partners in the criminal justice process, whether prosecutors acknowledge this or not. Minimizing rape survivors' experiences of a second assault requires that prosecutors become responsive to their key witnesses' realities and motivations and provide greater information and support before and during court events. When prosecutors approach witness preparation from the standpoint of their own needs they provide information and instruction that is too little and too late. When prosecutors approach survivors' emotions as resources they may undermine their case by adding to the negative emotional impact of the court event on their witness.  相似文献

针对压裂施工过程中破胶过早的问题,以过硫酸铵为芯材,选用适宜的聚合物为囊衣材料,采用分散分相法制备胶囊破胶剂。通过比较,确定了聚乙烯醇(PVA)和乙烯醋酸乙烯共聚物(EVA)为较好的囊衣材料,通过正交实验研究了两种胶囊破胶剂的制备工艺。结果表明:搅拌速率、温度、衣材与囊芯的质量比、衣材溶液和分散剂的质量分数对胶囊破胶剂性能有较大影响。制备PVA胶囊破胶剂的最佳条件为:温度25℃,搅拌速率270r/min,衣材与囊芯的质量比2:8,分散剂用量为1%;制备EVA胶囊破胶剂的最佳条件为:温度25℃,搅拌速率300r/min,衣材溶液和分散剂的用量为5%和2%。  相似文献

High school teachers evaluate and offer guidance to students as they approach the transition to college based in part on their perceptions of the student's hard work and potential to succeed in college. Their perceptions may be especially crucial for immigrant and language-minority students navigating the U.S. educational system. Using the Educational Longitudinal Study of 2002 (ELS:2002), we consider how the intersection of nativity and language-minority status may (1) inform teachers’ perceptions of students’ effort and college potential, and (2) shape the link between teachers’ perceptions and students’ academic progress towards college (grades and likelihood of advancing to more demanding math courses). We find that teachers perceive immigrant language-minority students as hard workers, and that their grades reflect that perception. However, these same students are less likely than others to advance in math between the sophomore and junior years, a critical point for preparing for college. Language-minority students born in the U.S. are more likely to be negatively perceived. Yet, when their teachers see them as hard workers, they advance in math at the same rates as nonimmigrant native English speaking peers. Our results demonstrate the importance of considering both language-minority and immigrant status as social dimensions of students’ background that moderate the way that high school teachers’ perceptions shape students’ preparation for college.  相似文献

用固相反应法制备了CaCu_3Ti_4O_(12)样品,对其介电常数、电容、电阻及击穿电压特性进行了系统研究.结果表明:预烧温度950℃和1 050℃烧结样品具有较高的转变温度(110~150K)和较高的介电常数(104);样品保温时间为6 h时,电容值达到最大为59.2 nF,电阻值最小为0.065 MΩ;在5~20 MPa压力范围,样品的电容值与压力关系呈线性关系.在不同条件下制备的CaCu_3Ti_4O_(12),其直流电压与电流关系大致相同且击穿电压非常高.在同一电压下,电流与试样的厚度成反比.由此推断,CaCu_3Ti_4O_(12)的直流电压与电流的关系,可能与材料的本身结构有关.  相似文献
